New York Kratom Bills Advance Through Committees as Advocacy Groups Mobilize

Multiple kratom-related bills are currently moving through the New York legislature, with some proposals targeting kratom beverages, alkaloid limits, and highly concentrated products. Advocacy groups and consumers are now organizing opposition efforts as these bills continue advancing through committee review.
Following is a review of bills in legislation currently, a link to 7Hopes website as they are organizing to fight these bills as well, and then a list of phone numbers and emails for New York senate, house, and assembly members that may impact these bills.

The Most Important Bills Currently Moving

S8925A / A9156 — 7-Hydroxymitragynine Restrictions

This is currently one of the most active kratom-related bills in the New York legislature.

The legislation would prohibit kratom products containing:

  • More than 2% 7-hydroxymitragynine by alkaloid content
  • More than 1mg of 7-hydroxymitragynine per serving

Supporters describe the bill as a consumer safety measure targeting highly concentrated products, while critics argue the language could severely impact legal products already being sold in New York and create a pathway toward broader restrictions.

Committee Timeline

  • Introduced and referred to Assembly Consumer Affairs & Protection
  • Recommitted and amended multiple times
  • Advanced into Assembly Codes Committee
  • Senate companion referred to Senate Consumer Protection

What Likely Happens Next

The bill could:

  • Continue moving through Assembly Codes
  • Receive additional amendments
  • Be scheduled for further committee consideration
  • Potentially move toward floor consideration if leadership advances it

Because this bill has already undergone amendments and committee movement, many advocates consider it one of the highest priority bills to monitor.

S8686 / A9114 — Kratom Food and Beverage Ban

Another major proposal would prohibit the sale and manufacture of food or beverage products containing kratom, kratom derivatives, or 7-hydroxymitragynine.

This bill has raised concerns among vendors and consumers because it could impact:

  • Kratom shots
  • Kratom beverages
  • Drink additives
  • Certain edible-style products

Committee Timeline

  • Assembly version referred to Assembly Consumer Affairs & Protection
  • Senate version referred to Senate Consumer Protection
  • Both remain active in committee

What Likely Happens Next

The bill may:

  • Remain in committee while negotiations occur
  • Be amended
  • Be advanced for additional committee review
  • Be combined politically with broader alkaloid restriction efforts

S10514 / A10969 — “Synthetic Kratom Kills Act”

This newer proposal focuses heavily on synthetic or adulterated kratom products.

The bill includes:

  • Restrictions on synthetic kratom products
  • Bans on injectable, combustible, or vape-style kratom products
  • Child-resistant packaging requirements
  • Product testing and labeling standards
  • Restrictions on kratom products incorporated into conventional foods or beverages
  • A 2% cap on 7-hydroxymitragynine

Some advocates support portions related to testing and adulteration controls, while opposing broader restrictions that could affect traditional kratom products.

Committee Timeline

  • Senate version referred to Senate Health Committee in May 2026
  • Assembly companion introduced shortly after

What Likely Happens Next

The bill will likely:

  • Remain in committee while stakeholders negotiate language
  • Potentially receive amendments
  • Be reviewed alongside related kratom proposals already moving through consumer protection committees

Existing New York Kratom Law

New York has already enacted:

  • 21+ age restrictions for kratom sales
  • Labeling and warning requirements

Those measures were signed into law previously and are already in effect.

Why We Are Mobilizing

We argue that –

  • Responsible adult consumers should maintain access to tested kratom products
  • Dangerous synthetic or adulterated products can be addressed without broad bans
  • Overly broad restrictions may unintentionally harm consumers and small businesses
  • With the draft regulations that Haven Access has written we can avoid many of the issues that lawmakers are associating the kratom alkaloids but are purely a product of a poorly regulated industry.

Right now 7Hope is organizing to make an in person appearance to fight these proposed bills, if you are in the area and interested in participating here is a link to their website.
