What This Bill Does

HB4930 is the more aggressive threat. It creates the Protect Communities from Unregulated Substances Act and would prohibit dispensing, distributing, manufacturing, or selling kratom or tianeptine products for human use unless approved by the U.S. Food and Drug Administration. It also imposes civil penalties of $10,000 per violation and gives enforcement authority to the Illinois Attorney General.

In practice, this is not a regulatory bill. It functions much closer to a ban, because kratom products are not generally sold under FDA approval pathways the way the bill requires. That would put ordinary kratom commerce at risk statewide. This is an inference from the bill’s approval requirement and penalty structure.
